Terms of Service

Welcome, and thank you for your interest in Certa IELTS. These Terms of Service ("Terms") govern your access to and use of the Certa IELTS educational platform, including all practice tests, mock exams, AI-powered writing feedback tools, and related services (collectively, the "Service"). By accessing or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.

1. Intellectual Property

The Service and its content (including text, graphics, logos, exam materials, AI feedback, and software) are owned by Certa IELTS and/or its licensors and are protected by intellectual property laws. We grant you a limited, non-transferable, non-exclusive license to access and use the Service for your personal, non-commercial learning purposes only.

2. User Account

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must provide accurate information when registering and keep it up to date.

2.1 Account Sharing and Access Restrictions

Your account and subscription are for your personal, non-commercial use only. You may not share your login credentials or allow others to access the Service using your account. Account sharing or unauthorised access is a violation of these Terms and may result in immediate suspension.

2.2 Content Use and Distribution

All test materials, practice questions, exam content, AI-generated feedback, and any other content provided through the Service ("Platform Content") are proprietary and protected by copyright. You are expressly prohibited from:

• Copying, reproducing, downloading, or extracting Platform Content for redistribution;
• Sharing or publishing Platform Content on any third-party website, social media, or public forum;
• Selling, licensing, or commercialising Platform Content in any form;
• Using automated tools, bots, or scripts to scrape or mass-download Platform Content;
• Providing access to Platform Content to non-subscribers through any means, including screenshots or screen recordings.

Unauthorised copying or distribution of Platform Content is a material breach of these Terms. We may suspend or terminate access for violations.

2.3 Prohibition on Code Theft and Site Replication

Any attempt to copy, reverse engineer, replicate, clone, or recreate the website code, architecture, business logic, test-delivery workflow, scoring mechanism, or any core working mechanism of Certa IELTS without explicit written authorisation is strictly prohibited. We reserve all rights to pursue legal remedies including claims for damages and injunctive relief.

3. Payment and Refund Policy

3.1 Subscription Payments

Access to paid features requires purchase of a subscription plan. All payments are processed securely through our third-party payment provider. By completing a payment, you confirm that you have read and accepted these Terms.

3.2 No Refund Policy

All subscription fees are non-refundable once payment has been processed and access to the Service has been granted. This applies in all cases including but not limited to:

• The user does not use the Service after purchase;
• The user cancels their subscription before the end of the billing period;
• The user's account is suspended or terminated due to a violation of these Terms.

3.3 Exceptions

A refund may be considered solely in the following circumstances:

• A verifiable technical failure on our part prevented access to the Service entirely for the full duration of the subscription period;
• A duplicate charge occurred due to a payment processing error.

To submit a refund request, contact us at certaielts@gmail.com within 7 calendar days of the payment date. We will review and respond within 10 business days.

3.4 Chargebacks

If you believe a charge was made in error, please contact us before initiating a chargeback. Unauthorised chargebacks may result in immediate suspension of your account pending investigation.

4. Subscription Terms

4.1 Plans and Billing

Certa IELTS offers subscription plans that grant access to the Service for a defined period. Subscriptions are billed in advance. Plan details, including pricing and included features, are described on our pricing page and are subject to change with reasonable notice.

4.2 Cancellation

You may stop using the Service at any time. You will retain access until the end of the period you have paid for. No partial refunds are issued for unused time within a billing period.

5. AI-Powered Features

AI-generated feedback, band scores, and evaluations provided through the Service are intended as learning aids only. They do not constitute professional assessment and do not guarantee any particular outcome in official IELTS examinations administered by the British Council, IDP, or Cambridge Assessment English. AI evaluation usage is subject to monthly limits defined by your subscription plan.

6. Service Availability

We aim to keep the Service available at all times but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance or technical issues. We reserve the right to modify, add, or remove features at any time with reasonable notice.

7. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE, UNINTERRUPTED, OR SECURE.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CERTA IELTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID IN THE THREE MONTHS PRECEDING THE CLAIM.

9. Changes to These Terms

We reserve the right to update these Terms at any time. When we make material changes, we will notify you by email or by displaying a notice on the Service at least 7 days before the changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the new Terms.
